Islander Balearic Charter S.L. – Terms & Conditions
By confirming a reservation with Islander Balearic Charter S.L. (“Islander Charter”), you acknowledge that you have read, understood, and expressly accepted the following Terms & Conditions, Cancellation Policy, Liability Disclaimer, Privacy Policy, and Additional Conditions.
Acceptance of these terms is mandatory to complete any reservation and authorize payment.
1. Company Information

2. Reservation & Payment
- A reservation is considered confirmed only once the agreed deposit or full payment has been received.
- The remaining balance must be settled before boarding. Failure to pay on time may result in automatic cancellation without refund of the deposit.
- By confirming a booking, you authorize Islander Charter to charge your card or payment method in accordance with the agreed booking terms.
3. Cancellation Policy
- Full refund of the deposit if cancellation is made at least 48 hours before the scheduled charter date.
- No refund of the deposit if cancellation is made within 48 hours of the charter date or later.
- No-show or late arrival will be considered a cancellation with no refund.
4. Cancellation Due to Weather or Safety Concerns
The safety of our guests, crew, and vessel is our highest priority.
- Islander Charter reserves the right to cancel or postpone a charter if sea or weather conditions are deemed unsafe (e.g., strong winds, high waves, reduced visibility, official storm warnings, or maritime advisories).
- Such decisions are made solely by the captain or company in the interest of safety and are final.
- In such cases, guests may choose between:
- A full refund of the deposit, or
- A rescheduled charter at no additional cost, subject to availability.
- Weather-related cancellations do not entitle guests to additional compensation or liability.
5. Guest Responsibilities & Rules Onboard
- Guests must comply with all navigation limits, passenger restrictions, and safety instructions provided by the captain or crew.
- Bringing aboard illegal substances, dangerous items, or engaging in unsafe conduct is strictly prohibited.
- The person making the reservation is responsible for ensuring all guests follow these rules.
- Any fines, penalties, or damages caused by guest negligence, misconduct, or non-compliance will be the responsibility of the guest(s).
- Children must be supervised at all times by their parents or guardians.
6. Disclaimer of Liability
- Participation in boating and water activities inherently carries risks. By booking with Islander Charter, you accept and assume all risks associated with the experience.
- Islander Charter, its owners, operators, and crew shall not be held liable for:
- Personal injury, illness, accident, or death;
- Loss or damage to personal belongings;
- Delays, itinerary changes, or service interruptions due to weather, mechanical issues, or unforeseen events.
- Liability is excluded except in cases of proven gross negligence or willful misconduct by Islander Charter.
- Guests are strongly advised to obtain personal travel insurance covering accidents, health, cancellations, and belongings.
7. Vessel Condition & Substitution
- The yacht will be delivered in a safe, seaworthy, and clean condition.
- If for any reason the reserved vessel becomes unavailable (mechanical failure, maintenance, etc.), Islander Charter reserves the right to provide a vessel of equal or superior standard, or issue a full refund.
- This substitution or refund releases the company from further liability.
8. Right of Withdrawal Policy
In accordance with Article 103(l) of the Spanish General Law for the Defense of Consumers and Users (Royal Legislative Decree 1/2007, of November 16), the right of withdrawal does not apply to leisure services that include a specific date or period of performance.
- Therefore the right of withdrawal does not apply once a booking for a specific charter date has been confirmed.
- However, in order to provide transparency and flexibility to our clients Islander Charter has established its own Cancellation Policy, which details the conditions and time frames under which a client may cancel or modify a reservation, as well as any applicable refunds.
- We recommend reviewing the Cancellation Policy before completing your booking.
9. Privacy & Data Processing (GDPR & Spanish Law Compliance)

- Purpose of Processing: We collect and process personal data solely for:
- Managing and confirming reservations, payments, and contracts;
- Complying with legal, tax, and maritime regulations;
- Communicating with guests regarding services, safety, and updates;
- Improving the quality of our services.
- Lawful Basis: Processing is based on the performance of a contract (Art. 6.1.b GDPR), compliance with legal obligations (Art. 6.1.c GDPR), and, where applicable, guest consent (Art. 6.1.a GDPR).
- Data Retention: Personal data will be retained only as long as necessary to fulfill contractual obligations and legal requirements. Once this period has expired, data will be securely deleted or anonymized.
- Data Sharing: Data may be shared only with trusted third parties necessary for service delivery (e.g., payment processors, booking platforms, insurance providers), always under GDPR- and LOPDGDD-compliant agreements. Data will not be transferred outside the European Economic Area (EEA) without adequate safeguards.
- Guest Rights: Guests may exercise their rights of access, rectification, erasure (“right to be forgotten”), restriction, objection, and portability. Requests must be sent to info@islanderyacht.com, providing proof of identity.
- Complaints: Guests have the right to file a complaint with the Agencia Española de Protección de Datos (AEPD) (www.aepd.es) if they believe their data protection rights have been violated.
- Confidentiality & Security: Islander Charter applies technical and organizational measures to guarantee the confidentiality, integrity, and security of personal data, preventing unauthorized access, loss, or misuse.
10. Applicable Law & Jurisdiction
- These terms are governed by the laws of Spain.
- Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Palma de Mallorca, Illes Balears, unless otherwise required by consumer protection law.
11. Acceptance
By completing the reservation and payment process, you confirm that:
- You have read, understood, and agreed to all the above terms.
- You authorize the charge to your card or payment method under the agreed conditions.
- You acknowledge that acceptance of these terms is a mandatory requirement for booking with Islander Charter.
