Company Information<\/h2><ol><li><strong>Company name<\/strong>: Islander Balearic Charter S.L.<\/li><li><strong>Tax Identification Number (NIF)<\/strong>: B70646146<\/li><li><strong>Registered address<\/strong>: Carrer Bisbe Sastre 3, Piso 2, 07011, Palma, Illes Balears, Spain.<\/li><li><strong>Email<\/strong>: <a rel=\"noopener\">info@islanderyacht.com<\/a><\/li><\/ol><hr><h2>2. Reservation &amp; Payment<\/h2><ul><li>A reservation is considered <strong>confirmed<\/strong> only once the agreed deposit or full payment has been received.<\/li><li>The remaining balance must be settled before boarding. Failure to pay on time may result in automatic cancellation without refund of the deposit. <\/li><li>By confirming a booking, you authorize Islander Charter to charge your card or payment method in accordance with the agreed booking terms.<\/li><\/ul><hr><h2>3. Cancellation Policy<\/h2><ul><li><strong>Full refund of the deposit<\/strong> if cancellation is made <strong>at least 48 hours before<\/strong> the scheduled charter date.<\/li><li><strong>No refund of the deposit<\/strong> if cancellation is made <strong>within 48 hours of the charter date or later<\/strong>.<\/li><li><strong>No-show or late arrival<\/strong> will be considered a cancellation with no refund.<\/li><\/ul><hr><h2>4. Cancellation Due to Weather or Safety Concerns<\/h2><p>The safety of our guests, crew, and vessel is our highest priority.<\/p><ul><li>Islander Charter reserves the right to <strong>cancel or postpone<\/strong> a charter if sea or weather conditions are deemed unsafe (e.g., strong winds, high waves, reduced visibility, official storm warnings, or maritime advisories).<\/li><li>Such decisions are made <strong>solely by the captain or company<\/strong> in the interest of safety and are final.<\/li><li>In such cases, guests may choose between:<ul><li>A <strong>full refund of the deposit<\/strong>, or<\/li><li>A <strong>rescheduled charter<\/strong> at no additional cost, subject to availability.<\/li><\/ul><\/li><li>Weather-related cancellations do not entitle guests to additional compensation or liability.<\/li><\/ul><hr><h2>5. Guest Responsibilities &amp; Rules Onboard<\/h2><ul><li>Guests must comply with all <strong>navigation limits, passenger restrictions, and safety instructions<\/strong> provided by the captain or crew.<\/li><li>Bringing aboard illegal substances, dangerous items, or engaging in unsafe conduct is strictly prohibited.<\/li><li>The person making the reservation is responsible for ensuring all guests follow these rules.<\/li><li>Any fines, penalties, or damages caused by guest negligence, misconduct, or non-compliance will be the responsibility of the guest(s).<\/li><li>Children must be supervised at all times by their parents or guardians.<\/li><\/ul><hr><h2>6. Disclaimer of Liability<\/h2><ul><li>Participation in boating and water activities inherently carries risks. By booking with Islander Charter, you <strong>accept and assume all risks<\/strong> associated with the experience. <\/li><li>Islander Charter, its owners, operators, and crew shall not be held liable for:<ul><li>Personal injury, illness, accident, or death;<\/li><li>Loss or damage to personal belongings;<\/li><li>Delays, itinerary changes, or service interruptions due to weather, mechanical issues, or unforeseen events.<\/li><\/ul><\/li><li>Liability is excluded <strong>except in cases of proven gross negligence or willful misconduct<\/strong> by Islander Charter.<\/li><li>Guests are strongly advised to obtain <strong>personal travel insurance<\/strong> covering accidents, health, cancellations, and belongings.<\/li><\/ul><hr><h2>7. Vessel Condition &amp; Substitution<\/h2><ul><li>The yacht will be delivered in a <strong>safe, seaworthy, and clean condition<\/strong>.<\/li><li>If for any reason the reserved vessel becomes unavailable (mechanical failure, maintenance, etc.), Islander Charter reserves the right to provide a vessel of equal or superior standard, or issue a full refund.<\/li><li>This substitution or refund releases the company from further liability.<\/li><\/ul><hr><h2>8. Right of Withdrawal Policy<\/h2><p data-start=\"218\" data-end=\"496\">In accordance with <strong data-start=\"237\" data-end=\"371\">Article 103(l) of the Spanish General Law for the Defense of Consumers and Users (Royal Legislative Decree 1\/2007, of November 16)<\/strong>, the <strong data-start=\"377\" data-end=\"415\">right of withdrawal does not apply<\/strong> to leisure services that include a <strong data-start=\"451\" data-end=\"493\">specific date or period of performance<\/strong>.<\/p><ul><li>Therefore <strong data-start=\"553\" data-end=\"595\">the right of withdrawal does not apply<\/strong> once a booking for a specific charter date has been confirmed.<\/li><li data-start=\"662\" data-end=\"963\">However, in order to provide transparency and flexibility to our clients<strong data-start=\"736\" data-end=\"775\"> Islander Charter<\/strong> has established its own <strong data-start=\"800\" data-end=\"823\">Cancellation Policy<\/strong>, which details the conditions and time frames under which a client may cancel or modify a reservation, as well as any applicable refunds.<\/li><li data-start=\"965\" data-end=\"1049\">We recommend reviewing the <strong data-start=\"992\" data-end=\"1015\">Cancellation Policy<\/strong> before completing your booking.<\/li><\/ul><h2>9. Privacy &amp; Data Processing (GDPR &amp; Spanish Law Compliance)<\/h2><ul><li><strong>Data Controller<\/strong>: Islander Balearic Charter S.L., Carrer Bisbe Sastre 3, Piso 2, 07011, Palma, Illes Balears, Spain. Email: <a rel=\"noopener\">info@islanderyacht.com<\/a>. <\/li><li><strong>Purpose of Processing<\/strong>: We collect and process personal data solely for:<ul><li>Managing and confirming reservations, payments, and contracts;<\/li><li>Complying with legal, tax, and maritime regulations;<\/li><li>Communicating with guests regarding services, safety, and updates;<\/li><li>Improving the quality of our services.<\/li><\/ul><\/li><li><strong>Lawful Basis<\/strong>: Processing is based on the performance of a contract (Art. 6.1.b GDPR), compliance with legal obligations (Art. 6.1.c GDPR), and, where applicable, guest consent (Art. 6.1.a GDPR).<\/li><li><strong>Data Retention<\/strong>: Personal data will be retained only as long as necessary to fulfill contractual obligations and legal requirements. Applicable Law &amp; Jurisdiction<\/h2><ul><li>These terms are governed by the laws of <strong>Spain<\/strong>.<\/li><li>Any disputes shall be subject to the exclusive jurisdiction of the competent courts in <strong>Palma de Mallorca, Illes Balears<\/strong>, unless otherwise required by consumer protection law.<\/li><\/ul><hr><h2>11.
