Terms and Conditions of Contract

Purpose of the Contract

This document regulates the terms and conditions under which Islander Balearic Charter SL (hereinafter referred to as “the Company”) offers boat rental services with and without skipper, including the “Day Charter” and the “Sunset Charter”.

Services Offered

Day Charter:

Description: 4-hour sailing excursion along the bay of Palma and its surroundings.
Duration: Up to 4 hours depending on weather conditions.
Departure Time: 11:00 (variable according to the sailing program).
Group Size: Up to 5 passengers.
Meeting Point: Club de Mar – Palma de Mallorca.

Sunset Charter:

Description: 5-hour sailing excursion along the bay of Palma and its surroundings.
Duration: Up to 5 hours depending on weather conditions.
Departure Time: 18:00 (variable according to the sailing program).
Group Size: Up to 5 passengers.
Meeting Point: Club de Mar – Palma de Mallorca.

Both types of charter include:

Captain.
Welcome photo and glass of cava.
Non-alcoholic drinks and water.
Stand-up paddle board and snorkel equipment.
Fuel.
Insurance.
VAT on all rates.

Reservations and Payments

Reservations: Reservations can be made through our website, by phone, or email. Reservation confirmation is subject to availability.
Deposit: A 50% deposit of the total price is required to confirm the reservation.
Final Payment: The final payment can be made on the day of embarkation on the boat, and can be through POS, cash, or bank transfer.

Cancellations and Refunds

Customer Cancellations:
Cancellations made more than 14 days in advance: Full deposit refund.
Cancellations made between 7 and 14 days before the charter date: 50% deposit refund.
Cancellations made less than 7 days in advance: Deposit will not be refunded.
Company Cancellations: In case of adverse weather conditions or any other force majeure, the Company reserves the right to cancel the service. In this case, the client will be offered the option to reschedule the departure or receive a full refund.

Service Conditions

Boarding and Disembarking: Customers must arrive at least 15 minutes before the agreed departure time. Delays by customers will not result in an extension of the charter time.
Number of Passengers: The maximum number of passengers allowed is 5. The Company must be informed of any changes in the number of passengers in advance.
On-board Conduct: Passengers must follow the instructions of the captain and crew at all times. The Company reserves the right to terminate the charter without refund if passenger behavior jeopardizes safety.

Liability

The Company is not responsible for the loss or damage of passengers’ personal belongings during the charter.
Passengers are liable for any damage caused to the boat or equipment due to negligence or misuse.

Insurance

The Company has liability insurance that covers possible incidents during the charter service. Passengers are also covered by this insurance, within the terms and conditions of the policy.

Applicable Law and Jurisdiction

The relationship between the Company and customers shall be governed by the current Spanish legislation. Any disputes shall be submitted to the courts and tribunals of Palma de Mallorca, Spain.
